Upgrading from 3.3.7 to 4.0.9 Error

After attempting an upgrade apache brings up an internal server error while tring to access the login screen

this is what i've seen in the apache error log

any idea what the issue could be?

Particularly Step 2 and 4.1
OTRS 6.0.x (private/testing/public) on Linux with MySQL database.

i restored all the the files mentioned in steps 4.1, went through it again just to make sure i didn't miss anything.

still no dice :(

The error log is complaining that it can't find a file and you've verified that the file exists in the location that the system can't find, and its case and spelling match?

I don't believe it.
OTRS 6.0.x (private/testing/public) on Linux with MySQL database.
